Lunch & Learn: Red Flag Law Update: Making Recommendations to Law Enforcement Regarding Firearm Possession

This session is at the Introductory: Assumes post-doctoral education status and limited familiarity with the topic. Designed for psychologists and other mental health professionals.

About the Program:
New legislation went into effect on January 1, 2024, known as Minnesota’s Red Flag Law. Specifically, when a mental health professional determines there is a significant risk of violence with a firearm, then they must communicate the threat or risk to the Sheriff’s office of the county where the client resides. In addition, the mental health professional must make a recommendation to the Sheriff’s office regarding the client’s fitness to possess firearms. Given that this is a relatively new law, questions remain in terms of how mental health professionals adequately conduct such an assessment and navigate this decision-making process. As such, this presentation aims to discuss various considerations with respect to assessing for risk of gun violence, as well as what to do once a mental health provider determines they must make a recommendation to law enforcement regarding a client’s fitness to possess firearms. Additional information regarding firearm-related subcultures, individual risk factors, and recognizing one’s own cognitive biases will be discussed.

This program qualifies for 1.0 continuing education credits. Attendees must attend entire session to gain credit. Registration fee includes access to live webinar, program agenda, program PowerPoint, and continuing education certificate.

Participants will be able to:
1. Describe the reporting requirements of Minnesota's Red Flag Law
2. Identify at least three questions to ask or things to consider when assessing an individual's firearm risk for purposes of the Red Flag Law.

About the Presenter:
Brie Pileggi, Psy.D., LP, ABPP earned her Psy.D. in Clinical Psychology from the Minnesota School of Professional Psychology (MSPP) at Argosy University. She is a licensed clinical forensic psychologist at Direct Care and Treatment – Forensic Services (DCT-FS) in St. Peter, Minnesota. She also owns a private practice, Veritas Forensic Psychology. Dr. Pileggi is board-certified in forensic psychology by the American Board of Professional Psychology (ABPP). She is also the Forensic Division Chair of the Minnesota Psychological Association (MPA). Dr. Pileggi completes forensic evaluations in Minnesota and for the federal government in both criminal and civil cases. She is also licensed to complete both in-person and remote evaluations through the PsyPact Commission. Additionally, her practice joined with two others in the country to form a training consortium, offering didactics for students, trainees, and other practitioners. Dr. Pileggi’s work includes completing forensic evaluations in the areas of competency to proceed, criminal responsibility, civil commitment, general and sexual violence risk assessment, and sentence mitigation. Additionally, she supervises postdoctoral fellows and conducts forensic evaluations in Spanish.

The Minnesota Psychological Association is approved by the American Psychological Association to sponsor continuing education for psychologists. The Minnesota Psychological Association maintains responsibility for this program and its content.
